13th Assembly of States Parties – December 2014

From 8-17December 2014, civil society from across the world joined states and other stakeholders in New York for the 13th annual Assembly of States Parties (ASP) to the Rome Statute of the International Criminal Court (ICC).

Throughout the year, NGO experts monitor the work of the ICC and ASP through our Issue Teams and issued recommendations ahead of ASP 13. Each year, the ASP is a pivotal event for the Coalition, with NGOs contributing to discussions through side events, advocacy meetings and press conferences.

What happened at ASP 13?

As the ICC’s governing body, the states parties that make up the Assembly discussed and made decisions on a number of issues central to the Court's operations.

ASP 13 was dominated by the election of six new judges. It took 22 rounds and as a result the Assembly had to reschedule part of its agenda. A resumed session will take place in June 2015.

Strong statements of support from African officials in particular set a positive tone for the 13th session of the Assembly of States Parties (ASP). In an atmosphere of constructive dialogue, stakeholders made statements of support for the Rome Statute system of international justice and the need to strengthen the ICC, paving the way for future sessions to include productive dialogue around crucial issues like domestic prosecutions and cooperation.

States made recommendations to improve the Court and its work and addressed issues of complementarity, ratification and activation of the Kampala amendments on the crime of aggression, cooperation and universality of the Rome Statute. The discussions on cooperation with the Court culminated in a resolution adopted at the Assembly which for the first time included a new paragraph on avoiding non-essential contact with ICC fugitives. A lack of agreement on proposed amendments to the ICC’s Rules of Procedure and Evidence means that they will continue to be considered next year.

States approved a budget of 130.6 million euro, a decrease of 8 million on what the Court had requested—largely for the ICC prosecutor’s new investigation and prosecution strategy—which in turn may have a direct impact on its work next year.

The estimated part for the Trust Fund for Victims consists of 18.16 million euros.
